What is Section 201 ?

Section 201 of the Trade Act of 1974 provides import relief measures (also known as Safeguards) for domestic industries. The measures provide temporary relief for U.S. industries when competitor imports increase so significantly that they cause serious injury or threat to the domestic industry. The Safeguard measures are temporary – they allow the U.S. President to raise import duties or impose nontariff barriers on goods entering the United States for a limited period so that domestic industry is given sufficient time to adjust to the competition.

Hong Kong’s Initiates Dispute Regarding U.S.-Origin Marking Requirement

What Happened

On October 30, 2021, Hong Kong, China requested consultations with the United States regarding U.S. measures affecting origin markings on goods imported from Hong Kong to the United States. On November 24, 2020, the United States and Hong Kong held consultations on the matter. On January 14, 2021, Hong Kong requested the World Trade Organization (“WTO”) to establish a dispute settlement panel. In response, the WTO established a dispute settlement panel on February 22, 2021.

US Imposes Additional Tariffs on EU Goods

U.S. Expands Trade War to EU

After winning the largest arbitration award (7.5 billion) in World Trade Organization (WTO) history in its dispute with the European Union (EU) over illegal subsidies to Airbus, the United States (US) will begin applying WTO-approved tariffs on certain EU goods beginning October 18. Although USTR has the authority to apply a 100 percent tariff on affected products, at this time the tariff increases will be limited to 10% on large civil aircrafts and 25% on agricultural and other products. The U.S. has the authority to increase td.he tariffs at any time, or change the products affected. Comment Today! USTR Publishes Preliminary List of EU Products To Be Covered By Additional Duties. 

Until recently the Section 301 Tariffs have been associated with China deceptive practices. The USTR is now expanding Section 301 Tariffs to the European Union (EU).  As a result of the World Trade Organization (WTO) repeatedly finding that EU subsidies to Airbus have caused adverse effects to the United States; the Office of the United States Trade Representative (USTR) has launched a process under Section 301 of the Trade Act of 1974 to identify products of the EU to which additional duties may be applied. These additional duties will be in effect from the dated published until the EU removes those subsidies.

Under the direction of President Trump, U.S. Secretary of Commerce, Wilbur Ross has initiated an investigation under Section 232 of the Trade Expansion Act of 1962, as amended. “The investigation will determine whether imports of automobiles, including SUVs, vans and light trucks, and automotive parts into the United States threaten to impair the national security as defined in Section 232.”
