• CBP activates lead field coordinator for Region IV, makes final preparations for arrival of Hurricane Idalia. 
• The Commercial Customs Operations Advisory Committee (COAC) will hold its quarterly meeting on Wednesday, September 20, 2023. Agenda items include: 
  • IPR working group update on the development of a portal on the CBP IPR web page 
  • Progress report on the ACE 2.0 initiative 
  • New recommendation from the Broker Monetization Working Group 
• CBP released a set of frequently asked questions (FAQs) on the Automated Export System (AES) response message 97H-Shipment on Hold.
• CBP updates instructions for Northern border customs brokers using ‘Permit Ports’ – the updated instructions explain to the customs broker the procedures for how to file a request to cross cargo at a “permit port.” These types of ports are not regularly staffed by CBP for crossing.

• CBP Releases July 2023 Monthly Update. In July 2023, CBP: 
  • Processed more than 3 million entry summaries valued at more than $262 billion.  
  • Identified nearly $7 billion of duties to be collected by the U.S. government. 
  • Stopped 388 shipments valued at more than $107 million for further examination based on the suspected use of forced labor. 
  • Seized 1,698 shipments that contained counterfeit goods valued at more than $165 million. 
• Fake Apple watches, wireless headphones worth nearly $400K seized by CBP at ONT and LA/LB Seaport. 
• Cincinnati CBP seizes 100 shipments containing counterfeit MLB, MLS, NFL merchandise. 
• CBP, FWS seize seahorses, snakes, snake oil, and prohibited pork products at Dulles Airport.

Customs and Border Protection (CBP)

• DHS announces two additional PRC-based companies as a result of forced labor enforcement. Effective August 2, 2023, goods produced by Camel Group Co., Ltd. and Chenguang Biotech Group Co., Ltd. and its subsidiary Chenguang Biotechnology Group Yanqi Co. Ltd. will be added to the UFLPA Entity List and restricted from entering the United States as a result of the companies’ participation in business practices that target members of persecuted groups, including Uyghur minorities in the PRC.
• CBP’s final rule for new Broker Continuing Education (CE) requirement became effective July 24. The agency published answers to a few frequently asked questions regarding CE credit reporting, how CE credits will be treated during the 2024-2027 triennial, and accreditors. • CBP detained forced labor merchandise may no longer enter a zone whilst awaiting decisions. The only available options are to pay storage at the port or a customs bonded warehouse.
• Luxury jewelry, handbags, watches & more worth almost $800K intercepted by CBP officers at Chicago’s international mail facility.
• CBP, the Office of Field Operations (OFO), the Customs Trade Partnership Against Terrorism (CTPAT), and the Trade Compliance (TC) program announced the next generation of the CTPAT Portal and the TC Portal.
  • The next generation of these Portals will move from their current, outdated architecture to a modern cloud-based system that will be more user-friendly, intuitive, and faster.

• CBP Seizes $3M in Counterfeit Watches – CBP officers at Dallas/Fort Worth International Airport seized five counterfeit Richard Mille watches originating from Hong Kong.
• Harmonized System Update: Harmonized System Update (HSU) 2308 was created on June 30th, 2023, and contains 855 ABI records and 178 harmonized tariff records. This update contains modifications mandated by the 484 (F) Committee, the Committee for Statistical Annotation of the Tariff Schedules, effective July 1, 2023.
• EAPA case update: Suzhou Quality Import and Export Co. (notice of initiation of investigation and interim measures).
• EAPA case update: Vanguard Trading Company LLC (notice of determination as to evasion).

• DHS to Ban Imports from Two Additional PRC-Based Companies as Part of Its Enforcement of the Uyghur Forced Labor Prevention Act (UFLPA) – The interagency Forced Labor Enforcement Task Force (FLETF), led by DHS, added two People’s Republic of China (PRC)-based companies to the UFLPA Entity List. Effective June 12, 2023, goods produced by Xinjiang Zhongtai Chemical Co., Ltd. and Ninestar Corporation and eight of its Zhuhai-based subsidiaries will be restricted from entering the United States as a result of the companies’ participation in business practices that target members of persecuted groups, including Uyghur minorities in the PRC.
